Terms and Conditions

Photography Services – Family & Sports Photography (Switzerland)

1. Scope of Services

The photographer provides photography services for family portraits, children, and sports events (including competitions, training sessions, and related activities).

The specific details of the service (date, location, duration, price, and deliverables) are defined in the booking confirmation, offer, or invoice.

The photographer retains artistic freedom regarding the style, composition, editing, and selection of images delivered.


2. Booking and Contract Formation

A booking becomes binding once the photographer confirms the session in writing (email confirmation is sufficient).

For certain bookings (events or large sessions), the photographer may request a deposit to secure the booking date.


3. Pricing and Payment

Prices are communicated in advance through an offer, price list, or booking confirmation.

Unless otherwise agreed:

  • Payment is due within 30 days from the invoice date.
  • Prices are indicated in Swiss Francs (CHF).
  • The photographer reserves the right to send payment reminders in case of late payment.

If the photographer operates below the Swiss VAT registration threshold, prices may be exempt from VAT according to Swiss regulations.


4. Cancellation and Rescheduling

Client Cancellation

If the client cancels a confirmed session:

  • More than 7 days before the session: no fee
  • 3–7 days before the session: up to 50% of the session price
  • Less than 48 hours before the session: 100% of the session price

Weather Conditions

For outdoor sessions, the photographer and client may mutually agree to reschedule due to unfavorable weather conditions.


5. Image Selection and Delivery

The photographer selects and edits the best photographs from the session.

Delivered images include:

  • Professional color correction
  • Basic retouching
  • High-resolution digital files (unless otherwise specified)

The typical delivery time is within 2 to 3 weeks after the photography session or event.

Images will be delivered through an online download gallery or secure file transfer.

RAW image files are not provided.


6. Usage Rights

After payment, the client receives a non-exclusive license for personal use of the images.

This includes:

  • Printing for personal use
  • Sharing with family and friends
  • Posting on personal social media accounts

The following uses require prior written consent from the photographer:

  • Commercial use
  • Resale of images
  • Substantial editing or modification of the images

7. Copyright

All photographs remain the intellectual property and copyright of the photographer according to Swiss copyright law.

Unless otherwise agreed, the photographer may use selected images for:

  • Portfolio
  • Website
  • Social media
  • Promotional materials

Clients may request in writing that their images not be used for promotional purposes.


8. Image Rights (Right to One’s Image)

In Switzerland, individuals have the right to control the use of their image.

For minors, consent must be provided by a parent or legal guardian.

Participants in sports events or photography sessions acknowledge that photographs may be taken as part of the service.


9. Data Protection

Personal data (name, email address, contact information) is processed only for:

  • communication regarding the session
  • image delivery
  • invoicing

The photographer complies with the Swiss Federal Act on Data Protection (FADP).


10. Liability

The photographer will make reasonable efforts to provide the agreed service.

However, liability is limited in cases of:

  • equipment failure
  • weather conditions
  • venue restrictions
  • other unforeseen circumstances beyond the photographer’s control.

11. Archiving

Edited images may be stored by the photographer for up to 12 months after delivery.

Clients are responsible for downloading and backing up their images once delivered.


12. Governing Law

These Terms and Conditions are governed by Swiss law.

The place of jurisdiction is the photographer’s registered place of business in Switzerland.
